These terms and conditions define the rules and regulations for the use of the Website of the Lingerie Forum, with registered office at Rua Luís de Camões N55 2460-014 Alcobaça under tax number – 257616799, with email forumdalingerie@gmail.com, with contact +351 916 961 847, hereinafter referred to as “Lingerie Forum"
By accessing this website, we assume that you accept these terms and conditions in full. Do not continue to use the Fórum da Lingerie website if you do not accept all of the terms and conditions stated on this page.
The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: Client , You and Your refers to you, the person accessing this website to accept the Company’s terms and conditions. The Company , We and Our , refers to our Company. Entity , Entities , or Us , refers to both the Client and us, or just the client or us.
All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client's needs in respect of provision of the Company's services/products.
Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.
REGISTRATION ON THE WEBSITE
-To place an order, the User may register in advance by filling in the fields on the form available on the website www.forumdalingerie.com.
-From the moment you access your personal account, the User is subject to these Terms and Conditions.
LINGERIE FORUM PRODUCTS
-The website www.forumdalingerie.com is aimed at all users who wish to purchase Fórum da Lingerie products, from their home or workplace, 24 hours a day, 7 days a week.
-Information about product characteristics can be found at www.forumdalingerie.com.
- Fórum da Lingerie reserves the right to modify, at any time, the information, product offering, prices, promotions and commercial conditions presented on the website www.forumdalingerie.com.
PLACE ORDERS ON THE WEBSITE
-To order on www.forumdalingerie.com, the User must have an email account and their browser must be configured to accept cookies and pop-ups, which will allow them to enjoy all the browsing conditions of the Fórum da Lingerie online store.
-The User may purchase products online, for which it is necessary that:
a) Find the product(s) you wish to purchase;
b) Add the selected product(s) to the “Shopping Cart”;
c) Register the User's personal data, which will be integrated into the Lingerie Forum database under the terms set forth in the Privacy Policy , including the “Delivery Address”, “Billing Address”, “Payment Method”, telephone number and tax identification number (NIF);
d) Review your order and confirm the order;
-The User will receive an order confirmation email with details regarding the payment method they selected.
-Your order will be delivered by the logistics operator to the delivery address indicated in the purchase process and with the respective detailed invoice.
-By submitting the order form, the User accepts the Terms and Conditions of purchase described at www.forumdalingerie.com, as well as the Privacy Policy.
-The Lingerie Forum reserves the right not to accept and cancel orders already confirmed in the following situations:
a) The product is not available;
b) Payment is not made using any of the payment options available on the website www.forumdalingerie.com;
c) Payment is not confirmed;
d) The billing information is not correct or verifiable;
e) There is an error in the price quote;
f) It is not possible to deliver to the address provided by the User.
PRICES
- Prices are all quoted in Euros (€). Please note that changing the delivery country may have an influence on prices due to different shipping costs. Customs costs relating to the country of delivery of the order will be borne by the customer.
-The prices of the products presented on the website are subject to change. Fórum da Lingerie reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
-If there is an error in the price of the products ordered, the Lingerie Forum or the User may, up until the order is shipped, cancel the order.
-The total price specified at checkout includes taxes from the country of origin (Portugal) and shipping costs.
-The User must pay only the amount specified in the order confirmation.
PAYMENT METHODS
-The User may pay for their purchases using Multibanco Reference (ATM), MBWAY, PAYPAL and credit/debit card.
-The Lingerie Forum does not accept any other payment method other than those mentioned in the previous point. The User should not attempt to pay by any means other than the specified payment methods. If you do so, we cannot be held responsible for loss of payment or any other damages that may result.
SHIPPING COSTS
-Shipping to Portugal costs €2.90.
-Outside Europe, all orders will have an associated shipping cost, which may require the payment of customs costs, depending on the country of delivery.
DELIVERY
-The Lingerie Forum sends the product(s) ordered by the User, from Monday to Friday, with the exception of holidays, and on the days and times used by the logistics company, to the delivery address provided by the User.
-Our delivery service does not include a scheduling option, therefore the order will be delivered without prior contact from the carrier, and it is necessary to ensure that someone is at the delivery address.
-Delivery times in Portugal vary between 2-15 business days depending on the item ordered. The response capacity of Fórum de Lingerie within these deadlines varies according to stock availability, as well as during promotions, sales and Christmas periods.
-The Lingerie Forum will inform the User of the unavailability of the product(s) ordered, and will proceed with the refund of the amount paid, within a maximum period of 15 (fifteen) days from the date of notification of the unavailability.
RIGHT TO FREE RESOLUTION
-The User may terminate the contract within 14 (fourteen) days after receiving the order, provided that:
a) The product(s) have not been used;
b) The product(s) maintain their original characteristics and labels intact;
c) The product(s) are complete. All material accompanying the order must be returned.
d) The product(s) are defective.
-The User may exercise his/her right of free resolution by sending the Free Resolution model or through any other unequivocal declaration of resolution of the contract, to the email forumdalingerie@gmail.com
-The costs of returning the order when exercising the right of free resolution are borne by the customer.
-Once the returned product has been received, Fórum da Lingerie will analyze and confirm the condition of the order and, when applicable, will refund the amounts paid by the User as stated in the order within a maximum period of 15 (fifteen) days, using the same method used to pay for the order.
-If the returned items show signs of use, Fórum da Lingerie reserves the right not to accept the return and to refuse to refund them.
-The User must note that, if the return has been made for reasons other than the justified existence of a defect or non-conformity of the products ordered, Fórum da Lingerie will not reimburse the shipping costs. Therefore, Fórum da Lingerie will not reimburse the expenses related to postage initially borne by the customer for the respective order.
-Please note that these conditions are only valid for orders placed in Portugal. If your order was placed outside of Portugal, please contact us via email at forumdalingerie@gmail.com
CANCELLATIONS AND RETURNS
-If the order was received after it was sent, the rules set out in the previous chapter regarding the right to free withdrawal will apply.
- The Lingerie Forum does not offer direct exchanges. The User may opt for a voucher to exchange their order for another item available on the website, and will be responsible for all costs related to the new shipment. Please note that orders placed with a voucher and subsequently returned will only be eligible for a new voucher as a refund.
-In the event that the product ordered is defective or otherwise non-compliant, the User may choose to:
a) replace the product;
QUALITY
The Lingerie Forum does not sell second-hand, defective or inferior quality products compared to those currently on the market. The main features of each product shown on www.forumdalingerie.com are found on each product page.
The Lingerie Forum will make every effort to ensure that the colors of products appearing on the website www.forumdalingerie.com are as accurate and realistic as possible. However, as computer monitors vary, we cannot guarantee that your monitor will display accurate colors.
COMPLAINTS
In view of the objective of continuous improvement of the services provided, the Lingerie Forum will seek to respond to and resolve complaints presented by the User within 5 (five) business days, via email forumdalingerie@gmail.com
WARRANTY AND AFTER-SALES SERVICES
Lingerie Forum products benefit from the guarantee of compliance provided for in the legislation applicable to the sale of consumer goods.
EXCLUSION AND LIMITATION OF LIABILITY
Fórum da Lingerie does not guarantee the uninterrupted operation of the website www.forumdalingerie.com, or any of its features, and it may be suspended to carry out maintenance, repair or updates.
The Lingerie Forum will not assume, in the same way, any responsibility for any damages, arising, directly or indirectly, from situations of force majeure that prevent the Lingerie Forum, in any way, from fulfilling its obligations, notably, strikes, failures in the electrical network, in telecommunications services or in any other services, fires, floods, impossibility of obtaining products, materials or services, breakdowns, delays by suppliers or carriers and changes in legislation or administrative regulations.
The Lingerie Forum is not responsible for any abusive use of the User's access data to the website by third parties, given that they are personal and non-transferable.
MODIFICATION OF TERMS AND CONDITIONS
Fórum da Lingerie reserves the right to change these Terms and Conditions at any time, considering the changes made and users notified by publishing the modified Terms and Conditions on the website www.forumdalingerie.com.
PROCESSING OF PERSONAL DATA
We ask that you read our Privacy Policy carefully so that you can be aware of the rules and procedures adopted by Fórum da Lingerie regarding the processing of data collected when you browse the website www.forumdalingerie.com and when you use the features it offers, as well as the applicable security and confidentiality measures.
